License
At this July 13th hearing, City Administrative Hearing Officer Albert
Chavez granted Walgreens its waiver to sell alcohol next to a school
and also its transfer to the new location.
The Loitering
Prevention Agreement was created to address some of the neighborhood's
concerns over security at the Wallgreens.
Association residents are requested to report problems concerning
loitering and security at the new Walgreens to the the neighborhood
association.
The Board will
collect observations and concerns to help monitor how things are working under
the waiver and loitering agreement.
LOITERING PREVENTION AGREEMENT
Pursuant to the request of THE CITY OF ALBUQUERQUE, WALGREEN CO.,
d/b/a Walgreens #9336 and the CITY OF ALBUQUERUE enter into this agreement
for loitering prevention:
1. Walgreens #9336desires to prevent its customers and employees
from being approached by individuals making requests or demands outside
the Walgreens store to be located at 2011 12th Street NW. (the “Proposed
Premises”) The terms of this agreement are intended to prevent
such individuals from loitering around the Proposed Premises.
2. Walgreens #9336 will request such individuals to leave the Proposed
Premises, will initially, and as long as loitering continues to
be a problem immediately around the Proposed Premises, hire security
personnel for the evening hours, will have Walgreens’ employees
conduct regular sweeps around the Proposed Premises and request that
any loiterers leave, will request the support of police officers to
assist in such efforts, and will work with Lowe’s to deter
and prevent such activity. The City of Albuquerque Police Department
will
respond to calls from Walgreens #9336.
3. Walgreens #9336 will add lighting for the Proposed Premises which
exceeds the outdoor lighting at the typical Walgreens’ store.
The average lighting across the property around the Proposed Premises
will be 10 foot candles, and is designed to comply with the New
Mexico Night Skies Act, in that all the lights are shielded to
prevent spillage
up or onto the neighboring property. There will be nine free standing
light poles, at 20 feet high, with three lights on each pole and
a shield over each light. There will be lights underneath the
front canopy every 8 feet and a light over all exterior doors
at 10 feet.
The drive thru will have 8 lights and an additional light at the
pharmacy
window. There will be two area lights on the west side of the
Proposed Premises and two area lights on the north side of the
Proposed Premises.
These area lights will be larger and throw light farther than
the other more concentrated lights Additional lighting fixtures
and/or
revisions to the current lighting plan will be implemented as
Walgreens deems necessary to comply with the intent of this agreement.
4. Walgreens #9336 will take all reasonable measures to prevent criminal
activity in or around the Proposed Premises, to the extent that Walgreens
#9336 is aware of such activity. The Safe City Strike Force will monitor
Walgreens # 9336..
5. Walgreens #9336 will sell only package liquor and will not sell
liquor for consumption on the Proposed Premises. Walgreens #9336 will
not sell alcoholic beverages in miniatures, will not sell single beers
in sizes of 16 oz or less, and will not sell fortified wines with
a volume of alcohol content of greater than 13.5 %. Initially, and
as long as a loitering problem continues, Waglreens #9336 will not
sell beer in quart containers or in cans of 40 ounces or less.
6. For security purposes, there will be no outdoor pay phones.
7. Walgreens #9336 will take all reasonable steps to terminate any
public nuisance activity on the Proposed Premises.
8. Walgreens #9336
will sell alcoholic beverages between 8 a.m. and 10 p.m., Monday
through Saturday and noon to 9 p.m. on Sundays and for no longer period
of
time.
9. Walgreens #9336 will not have any banners or flags which advertise
alcoholic beverages in windows or outside the building. Walgreens
# 9336 will have a permanent sign on the exterior of the building
which indicates that liquor is sold in the store. Nothing in this
paragraph shall be construed to prohibit Walgreens #9336 to advertise
liquor on the outside leader board.
10. Walgreens #9336 will meet with the neighborhood associations in
a year to review the situation.
